NEMA Annual Environmental Audit in Kenya: Who Must File, the 31 December Deadline, and How to Prepare
If your business is already operating in Kenya, whether it is a factory, farm, hotel, school or a development that holds an Environmental Impact Assessment (EIA) licence, an environmental audit is part of keeping your annual NEMA licence in good standing. It is a legal requirement, not optional paperwork. The National Environment Management Authority (NEMA) issues improvement orders to proponents who have not met specific environmental requirements, and it inspects facilities routinely. Getting the audit right each year is the cheapest way to stay ahead of both.
Quick answer: A NEMA environmental audit is a report that shows how far your operations match your environmental management plan and licence conditions. For operating businesses it is one of the requirements of your annual NEMA licence. It must be prepared by a NEMA-registered environmental expert and submitted to NEMA through its licensing portal, in the same way as an EIA or ESIA report. NEMA’s published deadline for annual audit reports is 31 December.
This guide is written for SME owners, factory and farm managers and compliance officers across Kenya who want to know what applies to them and what to do before the year ends.
What is an annual environmental audit?
An environmental audit is a systematic, documented and objective evaluation of the activities and processes of an ongoing project. Its purpose is to check how closely those activities follow the approved environmental management plan (EMP) that came with your EIA, or the baseline set by your first audit.
The legal framework is the Environmental Management and Co-ordination Act (EMCA) and the Environmental (Impact Assessment and Audit) Regulations, 2003. Under them, the owner or operator of a project must keep accurate records and report to NEMA each year on how far the project conforms with what its environmental studies promised.
There are two stages. An initial audit sets the baseline for an existing facility. NEMA’s guidance says projects that were already operating when EMCA came into force must complete one. After that, the annual audit tracks progress against that baseline and against your licence conditions.
Who must submit an annual environmental audit in Kenya?
The duty is not limited to construction projects or new developments. Operating businesses such as factories, hotels, agro-processors, schools, quarries, and real estate developments need an audit as part of their annual NEMA license requirements. NEMA says it reviews annual audit reports from businesses and other listed facilities.
If you are unsure, check four things:
- Is your business already operating, with or without an EIA licence, in a sector NEMA regulates?
- Do you hold, or need to renew, an annual NEMA licence?
- Do your licence conditions or an earlier NEMA letter require annual reporting?
- Has NEMA issued an improvement order that is still open?
A yes to any of these means you should plan for an audit. A compliance specialist can confirm in one conversation, which is far cheaper than finding out during an inspection.
NEMA environmental audit deadline, who prepares it and how to submit
NEMA states that annual audit reports are due by 31 December each year. If your annual licence falls due earlier, work back from that date. Booking an expert, visiting the site and writing the report takes weeks, so start well before the deadline.
| Question | Answer |
|---|---|
| Deadline | 31 December every year (NEMA’s published date). Earlier if your annual licence renewal falls before it |
| Who prepares the audit | A NEMA-registered environmental expert. The report is submitted like an EIA or ESIA report |
| How to submit | Through NEMA’s licensing portal (ENVIS, at licensing.nema.go.ke), with hard copies as NEMA requires |
| Lodgment fee | None for environmental audits, according to NEMA (it notes the cost of this service is under review). |
| Acknowledgement | Within one week of submission |
| Review and feedback | Within three months |
| If requirements are not met | NEMA issues an improvement order |
No lodgment fee does not mean no cost. Your expert charges a professional fee, your annual license has its own fees, and NEMA’s feedback may call for corrective work. Hard copy requirements can change, so confirm the current ones with NEMA before you submit.
How to prepare and submit your annual environmental audit: 7 steps
- Confirm your obligation. Pull out your NEMA licence, your EIA report and environmental management plan or your last audit report, and any NEMA letters or improvement orders.
- Appoint a NEMA-registered environmental expert. The audit must be carried out and signed by a registered expert or firm. Check the expert’s registration on NEMA’s register before you sign a contract.
- Collect your records. Gather monitoring results, waste and effluent records, permits and training logs for the audit year (see the checklist below).
- Inspect the site. Walk the facility against the EMP line by line: waste handling, effluent, emissions, noise, water use, chemical storage, worker safety and community concerns.
- Record findings and gaps. For every EMP commitment, note whether you comply, partly comply or do not, with evidence such as photos, test results and receipts.
- Write the report with a corrective action plan. Show what you will fix, who owns it and by when, then address any open improvement orders.
- Submit through NEMA’s licensing portal. Upload the report on the NEMA licensing portal (licensing.nema.go.ke) and deliver the hard copies NEMA asks for, as part of your annual licence requirements. Keep the acknowledgement and diarise the three-month review window so you can respond to feedback quickly.
Documents to have ready for your environmental audit
Auditors and NEMA officers look for evidence, not promises. Typical items include:
- NEMA licence, EIA report and environmental management plan, or your last audit report
- Previous audit reports and any NEMA improvement orders, with proof of action taken
- Waste records: types, volumes, storage, licensed transporters and disposal receipts
- Effluent and emissions test results from accredited laboratories, where your licence requires them
- Water abstraction and usage records
- Chemical and fuel storage records, spill response plan and drill records
- Staff training, occupational safety and incident logs
- Community complaints and how each was handled
- Photos of controls on site: bunds, drainage, waste bays, signage
Common mistakes to avoid
Five gaps worth avoiding when you prepare your audit:
- Leaving it to December. Experts book up, and rushed reports miss evidence.
- Using someone who is not NEMA-registered. A report from an unregistered person may be rejected, which can delay your annual licence. Check the registration first.
- Copying last year’s report. The audit must reflect what happened this year, including any change in operations or expansion.
- Reporting without evidence. Statements such as “waste is properly disposed” need receipts, manifests and photos behind them.
- Ignoring open improvement orders. NEMA expects compliance with earlier orders, so show what you did about each one.

Frequently asked questions
When is the NEMA annual environmental audit due?
NEMA states that annual audit reports are due by 31 December each year. If your annual licence renewal falls earlier, the audit is needed before then.
Is the environmental audit part of my annual NEMA licence?
For operating businesses, yes. In our experience the audit report is one of the requirements for the annual licence. Confirm the exact requirements for your facility with NEMA.
Who can carry out a NEMA environmental audit?
A NEMA-registered environmental expert or firm of experts. The audit report is submitted to NEMA in the same way as an EIA or ESIA report, so plan to appoint a registered expert rather than preparing it in-house.
Is there a fee to submit an environmental audit to NEMA?
NEMA states there is no lodgment fee for environmental audits, although it says the cost of the service is under review. You will still pay your expert’s professional fee and your annual licence fees.
What happens if my facility does not meet NEMA requirements?
NEMA reviews the report and issues an improvement order to proponents who have not met specific requirements. It also carries out routine inspections of facilities.
How long does NEMA take to respond?
NEMA acknowledges audit reports within one week and communicates its review within three months.
